Changes to Neonicotinoid Pesticides

Changes to Washington State pesticide law will restrict the use of some neonicotinoid pesticides starting January 1, 2026. Neonicotinoid pesticides labelled for outdoor plants will be designated for commercial use and can only be distributed by a licensed pesticide dealer. This includes but is not limited to pesticide products containing the following chemicals: acetamiprid, clothianidin, dinotefuran, imidacloprid, nitenpyram, nithiazine, thiacloprid, thiamethoxam. Registration Checklist


Pesticides registered with the Environmental Protection Agency (EPA) under Section 3 of FIFRA must also be registered with WSDA before distribution in Washington State.
To register submit:
  • Application for Registration of Pesticides 
  • 1 copy of the product label (preferably in a searchable PDF)
  • 1 copy of the Confidential State of Formula (CSF)
  • Registration fee ($650/product per 2 years). The fee for additional product registrations added during a company's registration cycle will be prorated by year so that all products registered by the company come due for renewal at the same time.
  • If your product contains a new active ingredient not previously registered by WSDA and the product is labeled for outdoor use, submit a copy of EPA’s Environmental Fate and Effects Division (EFED) final risk assessment and cover letter for the new ingredient.
If your product is a 100% repack of another or distributor product, please have your basic registrant submit a complete CSF. Products containing new active ingredients may require WSDA toxicology review, which will lengthen registration time.

Section 3 Supplemental Distributor Pesticides

  • Supplemental Distributor Pesticides are pesticides federally registered by a primary company but are allowed to be labeled and marketed by a second company through an agreement.
  • Notice of Supplemental Distribution of Registered Pesticide Product is the certification of the legal agreement between both companies and must be approved by EPA before the agreement is valid.
  • A Supplemental Distributor label cannot add or modify use directions or claims that are not on Section 3 EPA-approved master label.
  • Supplemental Distributor Pesticides are sometimes labeled for specific uses, industries, or regions, and may have certain claims or use directions omitted from the label that do not pertain to the specific use. 
  • EPA does not review supplemental Distributor labels, so the state becomes the sole reviewer of the Supplemental Distributor label. To register these labels WSDA must ensure that the label contains the same required language as in the EPA-approved master label.

Label Submission

All non-confidential documents may be submitted by email to pestreg@agr.wa.gov. Each label must be a separate document. Labels must be unsecured, searchable PDF files at a minimum 300 dpi resolution. Applications, agent letters, Safety Data Sheets (SDS), and other non-confidential documents may also be submitted via email to pestreg@agr.wa.gov.
 
DO NOT submit Confidential Statements of Formula (CSF) by email, as this is not a secure method of sending confidential business information. CSFs must be submitted via the secure Pesticide Registration CSF Portal.
