Food Safety Modernization Act (FSMA)

The Food Modernization Act (FSMA) is the first comprehensive update to federal food safety laws since 1938. The intent is to prevent, detect and respond to food safety problems, and increase the safety of imported foods.

Some things you need to know about FSMA

In 2011 the Food Safety Modernization Act (FSMA) was enacted into law by Congress. FSMA required the Food and Drug Administration (FDA) to develop new rules and update the Good Manufacturing Practices you may already be familiar with. One of these new rules is known as the Preventive Controls for Human Food Rule. This includes requirements to identify and control the food safety risks associated with your products, create and implement a written Food Safety Plan, have a written recall program and supply chain controls when necessary.

We encourage all processors to attend a Preventive Controls Qualified Individual Training Course in order to develop a food safety plan
 

What if I'm a small facility?


All food processors, dairy plants and warehouses in Washington State are affected by this new rule but not everyone is subject to the full requirements. Small Businesses or farms who also process food may be exempt from certain requirements of the Preventive Controls for Human Food Rule. The FDA has released guidance to help you understand the modified requirements.
 
Small Firms must self-attest with the FDA that their gross sales average less than $1,000,000 annuallyUntil the submission is completed you are expected to meet all requirements of the Preventive Controls Rule.
