Spray Adjuvant Registration

The purpose is to register spray adjuvant products that will be sold in Washington State.
"Spray adjuvant" means any product intended to be used with a pesticide as an aid to the application or to the effect of the pesticide, and which is in a package or container separate from the pesticide. Spray adjuvant includes, but is not limited to, acidifiers, compatibility agents, crop oil concentrates, defoaming agents, drift control agents, modified vegetable oil concentrates, nonionic surfactants, organosilicone surfactants, stickers, and water conditioning agents. Spray adjuvant does not include products that are only intended to mark the location where a pesticide is applied. Spray adjuvants are by definition pesticides in the state of Washington; RCW 15.58.030(31)(c). Every pesticide which is distributed within this state or delivered for transportation or transported in intrastate commerce or between points within this state through any point outside this state shall be registered with the director subject to the provisions of chapter15.58. However, registration is not required if: A pesticide is shipped from one plant or warehouse to another plant or warehouse operated by the same person and used solely at such plant or warehouse as a constituent part to make a pesticide which is registered under the provisions of chapter 15.58; or a written permit has been obtained from the director to distribute or use the specific pesticide for experimental purposes subject to restrictions and conditions set forth in the permit.

An application for registration must be accompanied by a fee of three hundred ninety dollars for each spray adjuvant, except that a registrant who is applying to register an additional spray adjuvant or other pesticide during the year the registrant's registration expires shall pay a fee of one hundred ninety-five dollars for each additional spray adjuvant or pesticide.

Along with the appropriate registration fee, Submit:
 
  • a completed Application for Registration of Pesticides (AGR 630-4216),
  • a Supplemental Information for Spray Adjuvant Registration (AGR 630-4119),
  • 1 copy of the product label (PDF or paper copy),
  • 1 copy of the Spray Adjuvant Confidential Statement of Formula (AGR 630-4325), and
  • Spray adjuvants labeled for aquatic use must be consistent with WSDA criteria.
Once all requirements have been met (complete application, CSF's and required fees submitted), the registration is normally issued within 60 days. However, the work unit experiences a heavier than normal workload from January until March when renewals are processed which can increase the registration time to more than two months.
All registrations issued by the department expire December 31st of the following year except that registrations issued by the department to a registrant who is applying to register an additional pesticide during the second year of the registrant's registration period shall expire December 31st of that year. Any registration approved by the director and in effect on the last day of the registration period, for which a renewal application has been made and the proper fee paid, continues in full force and effect until the director notifies the applicant that the registration has been renewed, or otherwise denied in accord with the provision of RCW 15.58.110.

Upon notice by the Department to deny a registration, a person may request a hearing under chapter 34.05 RCW.
