Application and Review Process


  • Before applying to WSDA for a WSEUP, determine whether EPA requires a federal EUP for the experiment. See EPA’s requirements and exemption criteria for federal EUPs.   
  • There is no fee to apply for a WSEUP.
  • Determine which type of WSEUP you need.
  • An applicant should submit a complete application package to WSDA for the appropriate permit type as early as possible and at least 60 days prior to the intended experimental use. Incomplete packages (such as an incomplete or unsigned application form, missing documents, or incomplete documents) will delay the review process and may result in denial or a missed timing window for product use.
  • The WSDA review process begins when an applicant submits a complete application package for the appropriate permit. WSDA reviews the application package, requests additional information or clarification as needed, and determines whether to issue a permit. 

What to Submit

Collective WSEUP – Submit a completed Collective WSEUP (AGR 630-4130) Application Form.

Individual WSEUP – Application Package Checklist:

  • Completed WSEUP application form, including signature and date:
  • Applicable labeling (container label and/or Experimental Use label)
  • Safety Data Sheet (SDS)
  • Written research plan – at a minimum, include the following descriptions/details:
    • Specify whether this is a first-time request for the experiment in Washington. For repeat requests, provide the most recent WSEUP number/year and describe how the new request differs.
    • Purpose of the experimental use – specify which types of data are sought and how the data would be used. Examples include supporting a Section 3 registration/amendment or other type of pesticide registration or special authorization – specify which type and the estimated timeframe.
    • Test methods / experimental design 
      • Describe how the experiment would be carried out.  Examples of details include overall protocol, plot sizes and replications, pesticide combinations to be tested, rates/methods/timing of application, and data collection/evaluation. Also, see the calculations below.
      • Specify how the applicator would use the requested pesticide, noting any differences from the Section 3 label or stating the applicator would follow the experimental use label.
    • Show calculations for determining the following:
      • Total amount of area, or other applicable measurement, to be treated with the requested pesticide.
      • Total amount of requested pesticide to be used.
    • For terrestrial sites: describe the location and surrounding area (for example, habitat type and proximity to sensitive areas including surface water). Include a map if applicable. 
    • Proposed timing window for pesticide application.
  • Confidential Statement of Formula (CSF) if the pesticide is unregistered and applied to a food or feed crop/site. Submit CSF separately via WSDA’s secure online CSF upload portal and enter “WSEUP” in the “Notes” field when filling out the entry screen.
  • EPA permit if federal permit required.
