Washington State Experimental Use Permit - Aquatic Sites
  What is the purpose of this permit?
A Washington State Experimental Use Permit is required for all experiments involving pesticides that are not registered, and for all experiments involving uses not allowed by the pesticide label. This permit allows such experiments on aquatic sites. All aquatic pesticides are classified as "restricted-use" in Washington State and therefore a WSDA license and aquatic endorsement for application is also required for aquatic applications under an Experimental Use Permit.
  What activities require this permit and who needs to get it?
Pesticides shall not be distributed or used for experimental purposes unless a written permit has been obtained from the director. All distribution and use of pesticides for experimental purposes shall be subject to restrictions and conditions described in the experimental use permit. This permit, which is issued by WSDA, is required for all experimental projects involving the application of pesticides that are not registered for use in aquatic environments, and for all experiments involving uses not allowed by the pesticide label. Coverage under a National Pollutant Discharge Elimination System (NPDES) permit may be required whenever an experimental pesticide is going to be applied to an aquatic environment. Coverage can be applied for under existing NPDES permits or under a new individual NPDES permit. Some NPDES permits include coverage for aquatic EUP's issued by WSDA. Uses of experimental pesticides are not exempt from other state/federal laws. Except as provided in RCW 17.21.203, a Demonstration and Research license is required to use or supervise the use of any experimental or restricted use pesticide when applied on small plots for research purposes.
  How do I apply?

  How much will it cost?
There is no fee.
  Do I need to include anything with my application?
- WSDA requires submission of a signed permit application (AGR 630-4128) with a copy of the Safety Data Sheet and pesticide label or label of the product you intend to use.
- One copy of the Confidential Statement of Formula is also required for WSEUP'S involving the application of an unregistered pesticide to a food or feed crop/site.
- Location (map) of the experimental use site, information/data to address potential risk to human health, environment or endangered species, and proposed mitigation measures.
- WSDA requires submission of a WSEUP application, EPA approval letter, label and EUP Program (Section G of the EPA Petition when a federal EUP is required.
  Is the decision for my license dependent on anything besides the information in my application?
Applications may be reviewed with other agencies or WSDA's Natural Resource Assessment Section (NRAS) prior issuing a decision. When appropriate, additional information may be requested.
  When will I receive my permit?
Your permit application will be reviewed once all the information has been provided. Submit the completed application to the WSDA at least 30 days prior to the proposed beginning treatment date. WSDA takes action on aquatic experimental use permits within 31 days.
  How long is it valid?
The permit is valid from the date of the department's approval through the stated expiration date, generally one year or less.
  What is the legal authority?
The requirements for experimental use permit are found in the Washington Pesticide Control Act (Chapter 15.58 RCW), and the General Pesticide Rules (WAC 16-228), and Section 5(f) of the Federal Insecticide Fungicide and Rodenticide Act.
