Section 24(c) Special Local Need (SLN) Pesticide Registration

A special local need (SLN) is an existing or imminent pest problem within Washington state for which WSDA, based upon satisfactory supporting information, has determined that an appropriate federally registered pesticide product is not sufficiently available. The purpose of this registration is to allow an additional use of a federally registered pesticide under Section 24(c) of the Federal Insecticide Fungicide and Rodenticide Act (FIFRA). When there is justification and the established criteria are met, a special local need registration may be obtained on a food or feed crop for which a tolerance has been established (or there is an exemption from the requirements of a tolerance), or on a non-food or non-feed crop or site. Some examples of a special local need include, but are not limited to: new application method or timing, different rate, new crop, new pest, less hazardous formulation, prevention of pesticide resistance or application to a different soil type.
Control of an existing or imminent pest problem for which there is not an appropriate federally registered pesticide product that is sufficiently available. It is normally pesticide applicators who have a need for a Section 24(c) Registration, however, the pesticide applicator group that is in need must work closely with the pesticide registrant who will ultimately submit a request to WSDA for the registration. Third-party SLN registrations are sometimes issued to a company or organization other than the registrant when the registrant of the product is not willing to apply for an SLN registration. However, third-party SLN registrations will not be issued without a letter of authorization from the registrant of the product.

WSDA does not require a fee to apply for an SLN registration, except when the particular pesticide product is not already registered in Washington. In that case there is a $650 registration fee (per 2 years). SLN registrations issued by WSDA must be maintained by the registrant with EPA at the federal level, which requires federal maintenance fees to be paid.

The following items must be included (when applicable): 
1. Cover letter - all SLN registrations. 
2. Draft SLN label (1 copy) - all SLN registrations. 
3. Current federal label (1 copy) - all SLN registrations. 
4. Completed EPA SLN application form - all SLN registrations except supplemental distributor SLN registrations. 
5. Letter of support from a WSU researcher, extension specialist or other unaffiliated expert verifying the special local need.** 
6. Letter of support from commodity organization and/or individual growers.** 
7. Residue data - required if food or feed use.** Tolerance - 40 CFR 180. 
8. Efficacy data - required for all uses.** 
9. Phytotoxicity data � may be required if foliar use of herbicide or plant growth regulator.** 
10. Effects on beneficial insects � data may be required if foliar or systemic use of insecticide or fungicide.** 
11. Aquatic risk assessment form - required except for indoor and seed treatment uses.** 
12. Confidential Statement of Formula - required if CSF is not already on file with WSDA. 
13. Letter of authorization from the primary registrant - required for supplemental distributor SLN registrations or third-party SLN registrations, or for �Me-Too� SLN registrations that cite proprietary data. 
14. EPA transfer letter - required if SLN registration was transferred to a new registrant. 
**Not required for supplemental distributor SLN registrations. 
And, include information on the product registration status: 
1. Is the product currently registered with EPA? 
2. Has registration for the proposed use or other uses of product have been denied, disapproved, suspended, or canceled?
3. Is the product is under special review at the EPA?
4. Is the pesticide undergoing Reregistration?
5. Is the product not similar to any federally registered product?
6. Is the use pattern not similar to any federally registered uses? 
Once all requirements have been met (complete application submitted), the registration is normally issued within one month, however, the work unit experiences a heavier than normal workload from January through March which may cause a slight delay during that time period.
All SLN labels expire on the fifth year after issuance, unless WSDA determines that a shorter period is appropriate.
As the state lead agency for pesticide regulation, WSDA has the authority under Section 24(c) of FIFRA to register an additional use of a federally registered pesticide on a food or feed crop for which a tolerance has been established (or on a non-food/non-feed crop or site) for use in a special local need situation. The requirements for pesticide product registration, including Section 24(c) registrations, are found in the Washington Pesticide Control Act (Chapter 15.58 RCW) and the General Pesticide Rules (WAC 16-228)
