Pesticide Registration

To register pesticide products that will be sold in Washington State.
Pesticides that require registration in Washington State include (but are not limited to) all insecticides, herbicides, fungicides, rodenticides, nematicides, disinfectants, germicides, biocides, plant regulators, defoliants, desiccants and spray adjuvants. Pesticides registered with the EPA under Section 3 of FIFRA must be registered with WSDA prior to distribution in Washington State. Also minimum risk pesticides (e.g. citric acid, corn gluten, garlic, mint oil) that are exempt from federal registration under Section 25(b) of FIFRA must be registered with WSDA prior to distribution in Washington State. Spray adjuvants, products that are used to increase the effectiveness of a pesticide (e.g. extenders, penetrants, spreaders, stickers, surfactants) or to modify the characteristics of the tank mix (e.g. acidifiers, defoaming agents, drift control agents), must also be registered with WSDA prior to distribution in Washington State. Every pesticide which is distributed within this state or delivered for transportation or transported in intrastate commerce or between points within this state through any point outside this state shall be registered with the director subject to the provisions of chapter 15.58. However, registration is not required if: A pesticide is shipped from one plant or warehouse to another plant or warehouse operated by the same person and used solely at such plant or warehouse as a constituent part to make a pesticide which is registered under the provisions of chapter 15.58; or a written permit has been obtained from the director to distribute or use the specific pesticide for experimental purposes subject to restrictions and conditions set forth in the permit. WSDA has the authority under Section 24(c) of FIFRA to register an additional use of a federally registered pesticide on a food/feed crop for which a tolerance has been established (or on a non-food/non-feed crop or site) for use in a special local need situation. A special local need could include: new application method or timing, different rate, new crop, new pest, less hazardous formulation, prevention of pesticide resistance or application to a different soil type. There is no fee to apply for an SLN registration, except that "stand-alone" SLN registrations (an SLN registration not associated with an existing registration) require the $650 registration fee (per 2 years) for each product. An application for registration must be accompanied by a fee of six hundred fifty dollars for each pesticide, except that a registrant who is applying to register an additional pesticide during the year the registrant's registration expires shall pay a fee of three hundred twenty-five dollars for each additional pesticide.

APPLICATION FEE
The application fee is $650 per product for a two year period. If you are registering a product during the second year of the cycle, submit $325 per product. Make checks payable to WSDA. There is no fee for SLN registrations (except for stand-alone SLNs). Include a copy of your application form with your mailed payment.
AGENT'S LETTER OF AUTHORIZATION
Applications submitted by a third party/agent must include a letter from the registrant allowing the agent to act on their behalf. The letter must be on registrant letterhead with the contact information of both parties.
LABELS
Submit a label in PDF format or one (1) copy of the final printed label (including federal supplemental labels and label booklets). Print label on 8 1/2" x 11" paper (2-sided for multiple page label). Do not submit EPA stamped label unless requested by WSDA. Do not submit additional graphics (e.g. DOT placards) or 2(ee) use recommendations.
SAFETY DATA SHEET (SDS):
An SDS is required for spray adjuvants and Section 25(b) products if they are labeled for commercial use. Do not submit an SDS for EPA registered (Section 3) pesticides or supplemental distributor products.
CONFIDENTIAL STATEMENT OF FORMULA
Products will not be registered until the complete CSF has been submitted. Submit all CSFs via the secure upload portal.
  • EPA registered products: Submit one (1) copy of the EPA approved CSF. If the EPA registration number is not correct, write the correct number on the CSF. If CSF is transferred from another registrant, submit a copy of the EPA transfer letter. The CSF must disclose all active and inert ingredients. In addition, if the CSF is a 100% repack of another registrant's product, have that registrant forward the CSF to WSDA (unless it is already on file).
  • Supplemental distributor products: Submit a letter of authorization from the basic registrant. The letter must include your company name, your product name, and the EPA distributor registration number. A copy of the EPA approved CSF must be on file with WSDA or be submitted to WSDA.
  • Spray Adjuvants: Complete and submit the WSDA Spray Adjuvant CSF form (AGR-707-4325). If the CSF is a 100% repack of another registrant's product or refers to another company's product, also have that company submit a copy of their CSF to WSDA. Contact Customer Service prior to submitting your application if you have questions.
  • Section 25(b) products: Complete and submit the WSDA Section 25(b) CSF form (AGR 707-4139). If the CSF refers to another company's product, have the company forward the CSF of their product and a letter of authorization to WSDA.
EPA'S ENVIRONMENTAL FATE AND EFFECTS DIVISION FINAL RISK ASSESSMENT AND COVER LETTER is required for any new Section 3 pesticide that includes a new active ingredient not previously registered by WSDA and is labeled for outdoor use. Submission of documents in PDF format is preferred.

Once all requirements have been met (complete application submitted including required fees), the registration is normally issued within 60 business days.
All registrations issued by the department expire December 31st of the following year except that registrations issued by the department to a registrant who is applying to register an additional pesticide during the second year of the registrant's registration period shall expire December 31st of that year. Any registration approved by the director and in effect on the last day of the registration period, for which a renewal application has been made and the proper fee paid, continues in full force and effect until the director notifies the applicant that the registration has been renewed, or otherwise denied in accord with the provision of RCW 15.58.110.
The requirements for pesticide product registration are found in the Washington Pesticide Control Act (Chapter 15.58 RCW) and the General Pesticide Rules (WAC 16-228).
