Definition

Pesticides:

Any substance or mixture of substances, including plant regulators, defoliants, desiccants and spray adjuvants, intended to prevent, destroy, control, repel, or mitigate any insect, rodent, snail, slug, fungus, weed, and any other form of plant or animal or virus, except viruses on or in a living person or other animal.

Home and Garden Pesticides:

"Home and garden use only" means any pesticide determined by the department to be packaged, labeled and marketed in a manner that clearly indicates the product is intended for personal use by the general public in and around a residence. In making this determination, the department will consider, but not be limited to, the following criteria:

     (a) Packaging;
     (b) Package size;
     (c) Label instructions;
     (d) Application method;
     (e) Equipment to be used;
     (f) Rates of application.
